Basic salary

The basic salary is the remuneration for the work carried out by the employee. It must be linked to the current pay scale, specifying a category, grade, step and harmonised pay level (Article L.95 of the Code: ‘equal work – equal pay’).

To be legally enforceable, the current pay scale must have a legal basis:

  • The current guaranteed cross-sector minimum wage (SMIG);
  • A company-level agreement;
  • A collective agreement.

Consequently, the term ‘agreed wage’ is used if the scale is derived from a collective agreement, or ‘category-based wage’ if the basic wage includes a wage supplement.
